SPORT 2000 rent
GENERAL TERMS AND CONDITIONS

PRELIMINARY REMARKS
The rental contract is made between the customer making the reservation (henceforth known as the patron) and the respective sports company, (henceforth known as SPORT 2000) from which the equipment is rented. The rental takes place solely according to the terms and conditions below.

Definitions:
All sports equipment and additional products that can be booked for hire online (e.g. skis, ski sets, snowboards, snowboard sets, ski boots, snowboard boots, cross-country skis, cross-country ski sets, touring skis, touring ski sets, helmets, poles, protectors, sledges, etc.) are hereinafter collectively referred to as sports equipment.
Enquiries (e.g. group enquiries) and bookings (e.g. online bookings) are hereinafter referred to as bookings.
Wherever masculine pronouns have been used (to improve readability), this refers to both male and female persons.

A. Services provided by SPORT 2000 rent:
SPORT 2000 rent maintains a web-based reservation and booking system for the advance booking of sports equipment. For this purpose, SPORT 2000 rent uses an encrypted SSL (Secure Socket Layer) connection, which establishes a secure connection between the customer and the SPORT 2000 rent reservation and booking system. This reservation and booking system includes sports equipment presentation and booking options from the respective hire shop.

B. Services provided by the hire shop:
The hire shop is obliged to supply the customer with all sports equipment in accordance with the e-ticket.
Should the corresponding sports equipment not be available when the customer arrives, a better or equivalent model from the current hire stock of the hire shop shall be made available to the customer at no additional cost. SPORT 2000 rent cannot be held responsible for delays in the supply of sports equipment.

C. Conclusion of the contract
The hire contract is concluded exclusively between the customer making the booking and the respective hire shop from which the sports equipment is hired. SPORT 2000 rent does not hire out sports equipment itself, but acts only as an agent.

1. BOOKING:

After the booking process has been completed with a successful payment, SPORT 2000 rent sends the e-ticket (booking confirmation) to the customer by email and also makes this e-ticket available for download on the booking completion page. As this email is automatically generated, SPORT 2000 rent also recommends that the customer regularly check their personal spam/junk folder for the corresponding email. Depending on the payment provider, it may take up to 24 hours to send the e-ticket. As a rule, however, the e-ticket will be delivered within 3 hours after receipt of payment. With this (printed) e-ticket, the customer can collect the booked sports equipment from the respective hire shop. SPORT 2000 rent also forwards the e-ticket to the respective hire shop.
By completing the booking, the customer confirms that their personal data, used for the professional adjustment of the sports equipment, are correct. It is expressly stipulated that the customer is not permitted to change the adjustments made by the hire shop without authorisation.
The booking becomes valid for the customer upon full payment and receipt of the e-ticket. For the hire shop, the booking becomes valid upon receipt of the e-ticket.
It is the customer’s responsibility to check that the e-ticket delivered is correct without delay. Any discrepancies between the e-ticket and the desired booking must be reported immediately to SPORT 2000 rent.

Booking reminder:
330 days after the last completed booking on sport2000rent.com, the customer receives a one-off, automatically generated reminder email. This will only be sent if there is no valid booking in the system for the current season. The reminder email will be sent to the email address of the last booking.

2. PRICES

The prices are the online prices shown on the SPORT 2000 rent website for the desired sports equipment.
The prices are inclusive of all taxes and fees applicable at the time of booking, minus the online discount.
Red crossed-out prices represent the in-store price at the hire shop and the black price represents the discounted online price.
Displayed prices as well as payment are exclusively in euros.
In case of an obvious price error, which must be obvious to the customer, SPORT 2000 rent reserves the right to cancel the booking without giving reasons.
It is stipulated that pricing is the responsibility of the respective hire shop. Regional price fluctuations are therefore possible and SPORT 2000 rent has no control over this.
SPORT 2000 rent does not currently charge a booking fee.

Discounts/promotion codes:
Promotion codes can only be redeemed at participating hire shops. Only one promotion code can be claimed per booking.
No online discount or other discounts are granted for model-specific bookings and skiing lessons.

Group offer:
The group offer is aimed at groups of between 10 and 50 people aged 18 and over, who book at least one piece of sports equipment per person. Individual pieces of sports equipment may be excluded from the group offer. The group enquiry must be made at least 3 working days before the first day of hire. The scaling of on-top discounts for group offers starts at a 5% discount on the online price. This offer cannot be combined with any other discount.

3. FEEDBACK

Booking process feedback:
72 hours after completing the booking process, the customer will receive a one-time automatically generated feedback email at the email address provided at the time of booking, through which feedback on the online booking process can be left (using stars). Providing this feedback is voluntary. (See privacy and cookie policy)

Hire feedback:
A few days after the last day of hire, the customer will receive a one-time automatically generated feedback email at the email address provided at the time of booking, through which feedback on the hire process can be left. Providing this feedback is voluntary. By providing feedback, the customer will automatically be entered in a competition.
The feedback will be sent to SPORT 2000 rent in full. In addition, the relevant hire shop will receive the sections of the answers concerning the hire shop by email. Transferring the booking number linked to this feedback to the hire shop requires the customer’s express consent. (See privacy and cookie policy)

4. PAYMENT

The hire price is payable in full online using the following payment methods:

Credit card (VISA, MasterCard and American Express) in all countries
PayPal in all countries
Apple Pay
iDeal in the Netherlands
SOFORT by Klarna
Klarna (invoice, payment by installments)

The payment is processed via the external payment provider (SIX Payment Services [Europe] S.A.). As a PCI DSS certified company, SPORT 2000 rent does not store any payment data.
In the event of a subsequent rebooking or refund, SPORT 2000 rent is entitled in agreement with the customer to debit or credit the corresponding amounts to the customer’s credit card account, PayPal account or customer account (e.g. direct debit refund). Any resulting fees (e.g. bank commission, exchange rate-related bank charges, etc.) shall be borne exclusively by the customer.

5. customer account

During each booking process, the customer has the option of creating a customer account when finalising the booking. The e-mail address selected during the booking process is automatically stored for the customer account and is required each time the customer logs in. The customer has access to all bookings made with this customer account from the time the customer account is first created. The customer account is linked to the e-mail address provided. Any subsequent change to the linked e-mail address will result in the cancellation of all bookings linked to the customer account. The customer has the following options in the customer account:

A) Saving and changing billing data

The customer has the option of saving and changing their billing data (first and last name, postcode & city, telephone number, street, country, email address) in the customer account. However, the preferred means of payment must be re-entered for each new booking or booking change. The billing data can also be updated in the Billing data section each time the booking is finalised.

B) Changing the personal details of a booking

The customer has the option of changing the personal details of a booking (first name and surname, date of birth, age group, riding ability, height, weight, shoe size) subject to the respective booking lead time of the booked dealer (up to 3 days before collection, depending on the dealer).

C) Changing the rental shop for a booking

The customer has the option of changing the rental shop for a booking, subject to the booking lead time of the newly selected retailer (up to 3 days before collection, depending on the retailer). Depending on the availability of the products and the general booking settings (age model, free child promotion, free helmet promotion, discount settings, validity of promotion codes, price list differences between the original and new retailer) of the newly selected retailer, the customer may be charged an additional fee or SPORT 2000 rent may issue a credit note. 

D) Changing the rental period of a booking
The customer has the option of changing the rental period of a booking, subject to the dealer's booking lead time (up to 3 days before collection, depending on the dealer). Depending on the availability of the products and whether the rental period is extended or shortened, the customer will be charged an additional fee or SPORT 2000 rent will issue a credit note. Promocodes used will only be accepted if they are valid for the respective rental period.

E) Changing the rental equipment of a booking
The customer has the option of changing the rental equipment of a booking, subject to the retailer's booking lead time (up to 3 days before collection, depending on the retailer). Depending on the addition or cancellation of individual products, the customer will receive an additional payment or a credit note from SPORT 2000 rent.

F) Additional payment/credit note
If the total amount of a booking is changed by a change made by the customer, a top-up payment is made by the customer or a credit note is issued by SPORT 2000 rent:

  1.  Additional payment: Due to the customer's change, the new amount exceeds the amount of the original booking. As the customer goes through a new booking process when making a change, the difference is shown accordingly in the shopping basket. The customer has the option of paying the difference using one of the available payment methods and will receive an updated e-ticket after successful payment. The original booking remains valid until full payment has been made by the customer. It will then be cancelled.
     
  2. Credit note: As a result of the customer's change, the new amount is less than the amount of the original booking. The customer will receive a confirmation by e-mail after completing his booking change that the difference will be refunded by SPORT 2000 rent. The refund will be made within 7 working days using the customer's chosen means of payment. The change leads to the cancellation of the original booking upon completion.

G) E-ticket issue
After each completed booking change, the customer receives an updated e-ticket with the same booking number as on the original e-ticket. Only the booking data on the e-ticket is updated. The new e-ticket must be presented when collecting it from the hire shop.

H) Price change
If a retailer's prices are updated between the time of the original booking and the time of the booking change, the change will be made at the rates valid on the day and the valid prices will be shown accordingly in the shopping basket. Any promotion codes will be applied in accordance with the redemption conditions and applied to the new total amount as a percentage. 
I) Liability 
If the customer makes a mistake when changing the booking (e.g. typing error, wrong period, wrong rental equipment, etc.), the customer is solely responsible for this. SPORT 2000 rent and the respective local SPORT 2000 dealer shall not assume any additional costs incurred as a result (e.g. travelling, accommodation, rental from third-party providers, etc.). 
J) Cancellation of bookings
The customer has the option of cancelling future bookings independently via the customer account. The general cancellation modalities apply. (see point 6. Changes/Cancellations)

6. CHANGES/CANCELLATIONS

Changes:
The customer can change the time and content of the booking up to 3 days before collection of the sports equipment at no extra charge.This change must be notified to office@sport2000rent.com within the stipulated period.

Cancellation:

It is stipulated that in accordance with Section 18 Para. 1 No. 10 FAGG (Act on Distance Contracts and Off-Premises Contracts), there is no legal right of withdrawal for "services provided in connection with leisure activities".

It is also stipulated that cases of force majeure such as unfavourable weather conditions or other influences beyond the control of SPORT 2000 rent fundamentally do not entitle the customer to cancel the booking free of charge.

a) Cancellation due to illness/accident:

In the event that a customer becomes ill or sustains an injury during the hire period, the following applies (to the person directly affected) upon presentation of a medical certificate: The hire price may only be refunded if the sports equipment is returned to the hire shop immediately after the onset of illness or injury. As soon as SPORT 2000 rent is aware of such a case, the hire price already paid minus the hire time already used will be refunded to the customer. A refund in the hire shop is not possible.

b) Cancellation without reason (without cancellation protection):

For a cancellation for other reasons SPORT 2000 rent charges the customer the following cancellation fees:

  • up to 5 days before collection: 15% of the rental price
  • up to 2 days before collection: 30% of the rental price
  • up to 1 day before collection: 70% of the rental price

If the customer cancels later than 24 hours before pick-up, SPORT 2000 rent will charge a cancellation fee of 100% of the rental price. Cancellation must be made in due time to office@sport2000rent.com or via the customer account.

c) Cancellation without reason (with cancellation protection):

With the help of the cancellation protection (5% of the value of the goods), which is subject to a charge, the customer can cancel the booking up to 24 hours before collection (collection is not the same as the 1st rental day) without giving any reason. Under certain conditions, this cancellation protection can also be free of charge (newsletter registration, entry of a promo code, booking via partner sites).

If the customer collects the sports equipment booked online too late or not at all, the hire price will not be refunded. The same applies if the customer returns the sports equipment early.

Cancellation confirmation:
After successful cancellation, the customer will receive a confirmation email to the email address provided at the time of booking.

6. GENERAL PROVISIONS

Privacy:
Here is the current version of our privacy policy.

Applicable Law/Court of Jurisdiction:
For all legal disputes in connection with online bookings via the SPORT 2000 rent website, Austrian law shall apply exclusively (excluding the Private International Law Act (IPRG) and the competent court at the registered office of SPORT 2000 rent shall have exclusive jurisdiction.

Contract language:
The German-language version is contractually binding.

Disclaimer:
Since SPORT 2000 rent only acts as an agent between the respective hire shop and the customer, and therefore is neither entrusted with the fulfilment of the hire contract nor has any control over it, no claims for damages can be made against SPORT 2000 rent (except for intent and gross negligence).

CONDITIONS OF HIRE
 

PRELIMINARY REMARKS
The guidelines of SPORT 2000 rent are presented below. Since the reservation process (and thus the activity of SPORT 2000 rent) is completed from this point on, the respective hire shop* may make deviating provisions in its conditions of hire.
If no deviating regulations are made by the hire shop, the following applies:
*Please note that these guidelines refer primarily to Austria and Germany. In all other cooperating countries, different regulations may apply due to different legal situations.

1.    RENTAL AGREEMENT
The rental agreement is concluded between the customer and the hire shop. The reservation becomes valid for the customer upon full payment and receipt of the e-ticket. For the hire shop, the reservation becomes valid upon receipt of the e-ticket.

2.    AVAILABILITY
The hire shop is obliged to make all sports equipment available to the customer in accordance with the reservation. Should the corresponding sports equipment not be available when the customer arrives, a better or equivalent model from the current hire stock of the hire shop shall be made available to the customer at no additional cost.
The hire shop cannot be held responsible for delays in the distribution of sports equipment caused by circumstances beyond the hire shop's control (in particular accidents, delays in the return of equipment from prior hires, force majeure, strikes, peak times in the hire shop, etc.). In this case, the hire shop will make every effort to provide the customer with sports equipment of an equivalent or better quality, in accordance with the stock available in the hire shop concerned.

3.    EXCHANGE
The hired sports equipment may be exchanged free of charge within the pre-booked category (except for model-specific bookings). Exchanges to a higher category will be subject to a surcharge according to the price list which must be paid on site. No money will be refunded for an exchange to a lower category.

4.    COLLECTION
The customer must personally present their e-ticket in the hire shop.
Upon request, the customer must present an official photo ID (e.g. passport or driving licence) in the hire shop for identification or age verification. The hire shop can make copies of these documents (in compliance with the data protection regulations), which serve for the proper processing of the rental contract.
The hire shop may also demand a deposit for the sports equipment, which will be refunded upon proper return of the sports equipment.
 
As a rule, the sports equipment can be picked up from 16:00 on the day before the first hire day. If the booking is made less than 48 hours in advance, collection the day before cannot be guaranteed.
The customer is responsible for knowing the respective hire shop opening hours.

Late collection:
If the customer collects the reserved sports equipment too late or not at all, the hire price will not be refunded.
Cases of force majeure such as unfavourable weather conditions or other influences beyond the control of the hire shop do not entitle the customer to cancel the booking free of charge.

5.    RETURN
The customer must return the sports equipment on the last day of the agreed hire period before the close of business, or on the following day as a rule before 09:00.
The customer is responsible for knowing the respective hire shop opening hours.

Early return:
If the customer returns the reserved sports equipment early, the hire price will not be refunded.
In the event of illness or injury to the customer during the hire period, the following regulation applies (to the person directly affected) upon presentation of medical confirmation: The hire price may only be refunded if the sports equipment is returned to the hire shop immediately after the onset of illness or injury. As soon as SPORT 2000 rent is aware of such a case, the hire price already paid minus the hire time already used will be refunded to the customer. A refund in the hire shop is not possible.

Late return:
In the event that sports equipment is used for longer than the agreed period and after consultation with the hire shop, the difference between the actually used hire period and the hire period already paid for must be paid on site at the standard hire prices.
If the hired sports equipment is not returned in due time without consultation, the respective hire shop reserves the right to file a complaint against the customer for theft [Unterschlagung] and reserves the right to take further legal action.

6.    DUE DILIGENCE OBLIGATIONS
When reserving, the customer shall confirm that their personal details are accurate. These are used to correctly set the sports equipment. If the customer has made false statements, the hire shop cannot be held responsible.
The customer must not change the professional setting made by the hire shop without authorisation.
The hire shop checks the hire equipment for defects. If the sports equipment already has defects at the time of hire, the customer can – if the hire shop is unable to remedy the 
defect – have the sports equipment replaced or, if this is not possible, to withdraw from the contract.
The customer is fully responsible for the hired sports equipment and must use it only according to its function and conditions of use with care and in the usual manner.
The sports equipment may not be passed on to third parties.
The customer must ensure that the sports equipment is stored in a way that will prevent confusion or theft. Storing skis away from others or in a ski depot are appropriate forms of safekeeping. During the night, storage in a locked ski room in the accommodation or in a locked vehicle constitutes appropriate storage.
The rented sports equipment is not insured, unless a nominal cover charge (e.g. breakage or theft protection) is also booked by the customer. The customer must pay for this themself. The hire shop can offer nominal cover charge. The terms and conditions of the respective hire shop apply exclusively to this nominal cover charge.
In the event of breakage or damage due to improper use or theft due to infringements of the imposed storage obligations, the customer shall be liable for the repair costs or the current value.
Theft must also be reported to the responsible security authority within 24 hours and immediately reported to the hire shop.

7.    APPLICABLE LAW, COURT OF JURISDICTION
All legal disputes shall be governed exclusively by Austrian law (excluding the International Private Law Act [IPRG]) and shall be subject exclusively to the jurisdiction of the competent court at the location of the hire shop.

8.    DATA PROTECTION
Personal customer data is processed on the basis of the fulfilment of the rental agreement and exclusively for this purpose.
